Justice Department Takes Legal Action Against Texas Immigration Enforcement Laws 

The Justice Department has filed a lawsuit against Texas, seeking to prevent the enforcement of recently enacted immigration laws known as S.B. 4. The lawsuit argues that these laws, which create state offenses related to crossing the U.S. Mexico border and violate the federal government's exclusive authority over immigration. According to Associate Attorney General Vanita Gupta, S.B. 4 is deemed unconstitutional under the Supremacy Clause, as states cannot adopt immigration laws that interfere with the framework established by Congress. The legislation imposes penalties for border crossings and allows judges to dismiss charges if the individual agrees to leave the U.S. voluntarily. Texas Governor Greg Abbott responded, suggesting that the Biden Administration should focus on securing the border instead of challenging Texas' efforts. The government's complaint draws on the precedent set in Arizona v. U.S. 2012 to argue that Texas is preempted from legislating on immigration, as Congress has established a comprehensive framework governing the entry of noncitizens into the United States.

El Departamento de Justicia ha presentado una demanda contra Texas, buscando impedir la aplicación de las leyes de inmigración recientemente promulgadas conocidas como S.B. 4. La demanda argumenta que estas leyes, que crean delitos estatales relacionados con el cruce de la frontera entre Estados Unidos y México, violan la autoridad exclusiva del gobierno federal sobre inmigración. Según la Fiscal General Adjunta Vanita Gupta, S.B. 4 se considera inconstitucional según la Cláusula de Supremacía, ya que los estados no pueden adoptar leyes de inmigración que interfieran con el marco establecido por el Congreso.
