On Tuesday, June 4, President Biden has announced significant restrictions on asylum claims as part of broader immigration policy changes. These measures include a new rule allowing asylum officers to consider statutory bars to asylum during initial credible fear screenings, enabling quicker removals of individuals deemed national security or public safety risks Additionally, migrants who cross the U.S. Southwest border unlawfully will generally be processed under expedited removal authorities and face a five-year reentry ban if ordered removed.
To mitigate the impact, the administration has expanded lawful pathways for migration, including the use of the CBPOne app for scheduling appointments at ports of entry and new family reunification parole processes for several countries. Despite these efforts, concerns have been raised about the accessibility and functionality of the CBPOne app and the safety of waiting in Mexico for appointments.
Furthermore, a federal appeals court has allowed these asylum restrictions to proceed temporarily, despite legal challenges likening them to Trump-era policies previously struck down by the courts. The administration continues to push for these changes as part of a comprehensive strategy to manage migration more effectively and address the root causes of regional migration.
