Since there has been a change in administration, my office has received many calls from individuals fearful of filing for their respective spouse or family member. Those fears are unwarranted. Please do not listen to false information. It is routinely best to file for a family member if that family member is eligible.

Filing an I-130, Petition for Alien Relative, is a crucial step in the process of helping an immigration relative either adjust their status in the United States or consular process abroad.
 

Eligibility

The I-130 petition is used by U.S. citizens or lawful permanent residents (green card holders) to sponsor a relative for a family-based immigrant visa. The eligible relatives you can sponsor include:
 

• Spouses

• Children (under 21, unmarried)

• Parents (if the petitioner is 21 or older)

• Siblings (if the petitioner is 21 or older)

• Other family members under certain circumstances
